The ZATTHU JEWELRY REWARDS loyalty points program (the “Program”) is a loyalty rewards program offered by Zatthu Jewelry to certain customers of Zatthu Jewelry. The program can be accessed through www.zatthujewelry.com/pages/rewards/. The Program allows individuals who have created an account (each, a “Program Member” or “Members”) to collect points (“Points”) in accordance with these terms and conditions when making purchases on items that Zatthu Jewelry (“Eligible Purchases”) on the Website, and to redeem those points for coupons, offered by Zatthu Jewelry . Members do not acquire any vested interest or entitlement to the continued availability of any particular reward, benefit or redemption level.
REQUIREMENTS
The terms and conditions set forth herein (the “Terms and Conditions”, and together with all terms and conditions set forth on the Program Website and any other terms and conditions accessible through any of the foregoing, collectively the “Program Terms”), as amended from time to time, apply to the Program. Zatthu Jewelry may, in its sole discretion, limit, suspend, change, expand, or otherwise modify the Program Terms at any time without notice. If the Program Terms are updated, Company will post the new Program Terms on the Program Website and indicate the date they were last updated, and no change will be effective until such change has been posted for at least ten (10) days. We encourage Members to read the Program Terms each time they use the Program. If you do not agree with the program terms and conditions, do not participate in the program.
ACCEPTANCE
By using the program or registering, you accept and agree to be bound by the program terms.
PROGRAM MEMBERSHIP
REGISTRATION FOR MEMBERSHIP
Membership is free and no initial purchase is required to become a member. To become a valid member, you must visit the Program page at www.zatthu.nl and complete the enrollment process by providing complete and accurate information. By completing your registration, you agree to the Program Terms.
PASSWORDS AND SECURITY
To become a member and enroll in the Program, you must create an account using your email address and a password of your choice. You are responsible for all activities that occur on your account. If you suspect any unauthorized use of your account, you must notify us immediately. Only one (1) account per person is allowed.
SUSPENSION RIGHTS; CAPACITY
If Zatthu Jewelry determines that a Program Member has abused the privileges of the Program, fails to comply with any of the Program Terms, or misrepresents Zatthu Jewelry, Zatthu Jewelry may, in its sole discretion, take such action as it deems appropriate. Including but not limited to suspending such Member's privileges under the Program, revoking one or more points in that Program Member's account, and/or revoking the Member's account in the Program, in each case with or without prior notice to the member and without liability to Zatthu Jewelry. No points will be awarded if, in Zatthu Jewelry's reasonable opinion, the goods purchased will be used for resale or commercial use, and any points awarded for such purchases will be forfeited. If a member has been awarded points for an offer or promotion where a member has purchased more products than reasonable quantities, the points awarded as a result of that offer or promotion may be forfeited without notice and the account may be suspended or closed. If a member fails to meet the capacity requirements set forth above, all points awarded to such member may be forfeited without notice and the account may be suspended or closed.
INACTIVE ACCOUNTS
A Program Member account shall be considered inactive if no points are earned in connection with such account for ninety (90) days. Once an account is deemed inactive, all points in such account may, in Zatthu Jewelry's sole discretion, be deemed forfeited by that member, with or without notice.
ACCOUNT CLOSURE
Points are reduced to zero upon termination of a membership.
SAFETY
If an account is used by another person, all points related to purchases made by that other person will be credited to the account associated with that member.
REWARD POINTS
SAVE; REDEEM
Points can be earned by Program Members by purchasing products through Zatthu Jewelry (www.zatthujewelry.com) as set forth in the Explainer Page, regardless of the method of payment, provided that one is logged in to his/her account during checkout on the checkout page. Zatthu Jewelry reserves the right to change the number of points awarded for purchases at any time in accordance with these terms and conditions. Points can be redeemed for coupons offered by Zatthu Jewelry. When enough points have been accumulated to receive the desired coupon(s), redemption can be made through the Program Member's account. Each member is responsible for ensuring that all personal information is correct and up to date. Members are solely and fully responsible for keeping their account secure. If a purchase price is less than the redemption value of the points, the remaining (Euro) value associated with all used points will be forfeited. Points are not the property of the Member and may be withdrawn at any time by the Company as set forth herein.
WHERE THE
Points have no cash value and cannot be exchanged for cash. The accumulation of points does not entitle the Program Members to vested rights, and Zatthu Jewelry in no way guarantees the continued availability of any reward, redemption value, discount or any other benefit. Zatthu Jewelry assumes no liability to Members regarding the addition or removal of items from or for which points may be collected and/or redeemed.
TRANSFERABILITY
Except as permitted by Zatthu Jewelry from time to time, Points may not be assigned, redeemed, traded, bartered, purchased or gifted or otherwise sold. All points obtained in this way are void. For the avoidance of doubt, such prohibited transfers include transfers by operation of law upon the death or succession of a member.
RETURN / EXCHANGE POLICY
In the event of a return/exchange of a qualifying purchase that initially earned points, such points will be automatically deducted from the account used for the qualifying purchase. Points are deducted at the same rate at which they were earned. When returning and/or exchanging products awarded by redeeming points, all redeemed points will be forfeited.
PROMOTION
From time to time, the Company may advertise or offer exclusive sales to select members to redeem points for items other than the standard program coupons.
PRIVACY
PERSONAL DATA
You understand that by using the program, you consent to the collection and use of all personal information collected from members, including, but not limited to: name, address, email address, telephone numbers, date of birth, and order information (“Personal Information ”). As part of providing the Program, we may need to contact you and provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the program and your account.
SIGN OUT
By sharing your email address and as an active customer and program member, we may communicate special offers, services, promotions and program information to you. You may opt out of receiving such communications at any time by updating your account, or by contacting Zatthu Jewelry customer service, or by clicking unsubscribe at the bottom of any promotional email.
GENERAL
ACCEPTANCE
By enrolling in the Program, each member represents his or her consent to the collection and use of certain personal information by Zatthu Jewelry, unless he or she otherwise notifies Zatthu Jewelry and agrees to the Program Terms, such as these may be changed from time to time.
OTHER TERMS
These Terms are in addition to all other Program Terms and our Terms of Use and Privacy Policy posted on the Program Website, and shall be read together with such other Program Terms as one and the same instrument; provided that if there is a conflict between terms set forth in these Terms and Conditions, the Program Website, the Explainer Page and/or other Program Terms, such conflict shall be resolved as follows: first, the Terms of Use and Privacy Policy posted on the Program Website; after that, the explanation page prevails; then these General Terms and Conditions; then the Program website; and finally all other Program Terms. For the avoidance of doubt, in the event of any action, proceeding or other dispute arising out of or related to Program Terms, such dispute shall be resolved in accordance with the terms and procedures set forth in these Terms and Conditions.
ABUSE
Any abuse by a member of the privileges of the program, any non-compliance by a member with these terms and conditions, or any misrepresentation by a member may result in the member being banned from the program, including forfeiture of all accumulated points .
EXEMPTION
Every effort has been made to ensure that the information contained herein is correct. The Company is not responsible for errors or omissions in printed copies of these Terms and Conditions, nor in copies published from time to time on the Program website. Any waiver by Zatthu Jewelry of any member's strict adherence, performance or compliance with any of the terms and conditions contained herein, whether expressly granted or by policy, shall be effective only on a particular case basis and shall not be deemed to are a waiver of any rights or remedies of Zatthu Jewelry resulting from any other non-compliance, performance or compliance with the terms and conditions. No delay or failure by Zatthu Jewelry in exercising any right or remedy hereunder shall operate as a waiver thereof or any other right or remedy. In the event that any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, such provision shall not affect the validity and enforceability of any other remaining provisions of these Terms and Conditions.
LIMITATION OF LIABILITY
Zatthu Jewelry is not responsible for incorrect or inaccurate transcription of information, for problems related to equipment or programming related to the Program or used by the Member, for human error, for any interruption, deletion, omission, malfunction or line failure of any telephone network, mobile network or electronic transmission, for problems related to computer equipment, software, inability to access the Program website or online service, or for any other technical or non-technical error or malfunction. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL ZATTHU JEWELRY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR ANY REWARDS OFFERED THROUGH THE PROGRAM, EVEN WHETHER THEIR AUTHORIZED REPRESENTATIVES ARE AT THE EXTENT OF THE POSSIBILITY OF SUCH DAMAGES. IF ZATTHU JEWELRY DENIES UNLAWFUL MEMBER, LIABILITY SHALL BE LIMITED TO THE EQUIVALENT NUMBER OF POINTS. BY PARTICIPATING IN THE PROGRAM, THE MEMBER WAIVES ALL RIGHTS TO MAKE ANY CLAIM OR ACTION RELATING TO SUCH MATTERS IN ANY FORUM LONGER THAN ONE (1) YEAR AFTER THE FIRST EVENT OF THE TYPE OF ACT, EVENT, CONDITION OR Omission WHICH THE CLAIM OR ACTION IS BASED ON.
